By accessing and using our website (https://timelytics.co) and services, you agree to comply with and be bound by the following terms and conditions: 1. INTRODUCTION These Terms and Conditions govern your use of the Timelytics website and services provided by Timelytics (referred to as "we", "us", or "our"). If you do not agree with any part of these terms, please do not use our services. 2. SERVICES Timelytics is a time tracking and productivity analytics service that: - Pulls data from your Google Calendar through secure API access - Provides time management insights and analytics - Offers AI-powered productivity recommendations - Helps you optimize your time usage and achieve your goals 3. USER DATA AND PRIVACY 3.1 Data Collection We collect the following personal information: name, email, and payment information. The events from your Google Calendar are accessed through an API and processed for analytics purposes. We also collect non-personal data through web cookies. Please refer to our Privacy Policy for detailed information. 3.2 Data Processing Rights You have the following rights regarding your data: - Right to access your personal data - Right to rectify inaccurate data - Right to erasure of your data - Right to data portability - Right to restrict processing - Right to object to processing - Right to withdraw consent - Right to opt-out of AI processing 3.3 Data Export and Portability You can export your data at any time through our data export functionality at /api/user/data-export. 4. SUBSCRIPTIONS AND PAYMENTS 4.1 Subscription Terms Users can subscribe to our services on a monthly basis. Subscriptions automatically renew unless cancelled. 4.2 Refund Policy We offer a 7-day money-back guarantee for all new subscriptions. If you are not satisfied with our service within 7 days of your initial subscription, you may request a full refund by contacting support@mg.timelytics.co. After the 7-day period, no refunds will be provided except as required by applicable law. 4.3 Cancellation Users can cancel their monthly subscription at any time through their account settings or by contacting support. Cancellation will take effect at the end of the current billing period. 4.4 Price Changes We may change our pricing with 30 days' notice. Price changes will not affect your current billing period. 5. SERVICE LEVEL AGREEMENT 5.1 Uptime Guarantee We commit to 99.9% uptime for our core services. If we fail to meet this standard, you may be eligible for service credits. 5.2 Support Response Times - Critical issues: 4 hours - General support: 24 hours - Feature requests: 72 hours 6. USER RESPONSIBILITIES 6.1 Acceptable Use You agree to use our services only for lawful purposes and in accordance with these terms. You agree not to: - Use the service for any illegal or unauthorized purpose - Attempt to gain unauthorized access to our systems - Interfere with or disrupt the service - Use the service to transmit harmful or malicious code 6.2 Account Security You are responsible for maintaining the security of your account and password. We cannot and will not be liable for any loss or damage from your failure to comply with this security obligation. 7. INTELLECTUAL PROPERTY 7.1 Our Rights The service and its original content, features, and functionality are owned by Timelytics and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. 7.2 Your Rights You retain ownership of your data and user-generated content. You grant us a limited license to process your data for service provision. 8. LIMITATION OF LIABILITY 8.1 General Limitation To the maximum extent permitted by applicable law, Timelytics shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses. 8.2 Maximum Liability Our total liability to you for any claims arising from or related to these terms or the service shall not exceed the amount you paid us in the 12 months preceding the claim. 9. DISPUTE RESOLUTION 9.1 Governing Law These terms are governed by Swiss law, with additional protections provided by applicable consumer protection laws in your jurisdiction. 9.2 Dispute Resolution Process In the event of a dispute: 1. Contact our support team first 2. If unresolved, we will attempt mediation 3. If mediation fails, disputes will be resolved in Swiss courts 4. EU consumers may use EU Online Dispute Resolution platform 9.3 Class Action Waiver You agree to resolve disputes individually and waive any right to participate in class action lawsuits. 10. CHANGES TO TERMS 10.1 Notification We may update these terms from time to time. Users will be notified of any changes via email at least 30 days before the changes take effect. 10.2 Acceptance Your continued use of our services after such changes constitutes acceptance of the updated terms. 11. TERMINATION 11.1 Termination by You You may terminate your account at any time by contacting support or using the account deletion feature. 11.2 Termination by Us We may terminate or suspend your account immediately, without prior notice, for conduct that we believe violates these terms or is harmful to other users or our service. 11.3 Effect of Termination Upon termination, your right to use the service will cease immediately. We will delete your data within 30 days of termination. 12. MISCELLANEOUS 12.1 Severability If any provision of these terms is held to be invalid or unenforceable, the remaining provisions will continue to be valid and enforceable. 12.2 Entire Agreement These terms constitute the entire agreement between you and Timelytics regarding the service. 12.3 Waiver Our failure to enforce any right or provision of these terms will not be considered a waiver of those rights. 13.
